Frequently Asked Questions About Family Law

Family law issues are among the most challenging and emotional cases that make it into the courtroom. Our clients often have similar questions, including:

What should I consider when filing for divorce?

Every situation is different, but most people begin by gathering critical documents, such as tax records, property deeds and other personal papers. You also need to consider what living arrangements you need and how to separate your life – physically and financially – from your spouse. If you have minor children, you need to think about the parenting arrangement you want.

How is child custody determined in a divorce case?

Texas courts must always determine child custody, which is known as “conservatorship,” based on the best interests of the child. This means evaluating a variety of factors, including each parent’s ability to provide for the child’s physical, emotional and developmental needs.

What are the steps involved in the adoption process?

Generally, you will need to submit to a home study, which is a formal assessment of your home to see if your lifestyle is suitable for a child, and a background check. Then, you will need to decide on the type of adoption you wish to pursue, contact an adoption professional and wait until you are matched with a child. Following placement, you will have to go through post-placement visits and a finalization hearing. The hearing, which is where the adoption is formalized, cannot take place for at least six months after a child is placed in your home.

How is child support calculated and enforced?

In general, child support is a percentage of the noncustodial parent’s net monthly resources (up to $9,200). If you have one child, you are expected to contribute 20% of your net monthly resources, 25% for two children, 30% for three children, 35% for four children, and 40% for five or more children.

What are my options for resolving family disputes outside of court?

Agreement by mutual consent or mediation can often resolve family laws without costly, invasive court action. Working with an attorney like those at Chacon, Campbell & Alexander, PLLC, can help you learn more.
