When you are approaching a divorce, everything can seem very uncertain. Here are the questions our attorneys frequently hear:
What are the grounds for filing for divorce?
Typically, most couples file for divorce based on “insupportability,” which is the idea that conflicts or discord have made the marriage unsustainable. This is the “no-fault” option. Other fault-based grounds include adultery, cruelty or violence; abandonment for a duration of one year or longer; confinement due to insanity for three years or longer; conviction of a felony; and imprisonment for one year or longer.
How long does the divorce process typically take?
To file for divorce in Texas, at least one spouse must be a resident of the state for six months and a resident of the county where they wish to file for 90 days. There is then a 60-day waiting period from the day the petition is filed before the divorce can be approved. In reality, it may take several months for an uncontested divorce to work through the process and several years for a contested divorce.
What is the difference between a contested and uncontested divorce?
An uncontested divorce is one where a couple can agree on all the terms of the split. An uncontested divorce can be resolved without court intervention. A contested divorce is one where the couple cannot agree on at least one issue and the divorce has to be litigated.
How are assets and debts divided in a divorce?
Texas is a community property state, so that generally means that marital assets and debts will be divided 50/50. However, the law also requires community property to be divided with an eye to what is “just and right,” and that may result in an uneven split based on the circumstances of your case.
How can we minimize the potential impacts of divorce on children?
It’s generally understood that high-conflict relationships between parents are more damaging than the actual divorce itself. Mediation and collaboration between the parents with the best interests of the children in mind can minimize disputes and help prevent children from feeling unduly distressed.
